This might be a little off-topic, but I think it illustrates the mindset of many. The following link to a CNN video on Huff page titled Anderson Cooper Stuns GOP Rep. On 'Terror Babies': 'They Did Not Tell Me You Were Going To Grill Me' (VIDEO) Terror Babies Being Born In the U.S. My oh my...leave to a Texas State Legislator to drop this on the public. I have to hold my head in shame.

I agree with the opening premise that this is 1) purely a private property/zoning issue, 2) those who raised the issue did so purely for political purposes. I disagree that the response was "pandering" to anyone/anything. The problem, Iss, is that you constantly - indeed, I can't think of a counter-example - attribute political/pandering motives to anyone who states something that you disagree with. On the contrary, there are many people who have strong ethical reasons for taking stands on subjects, and reasonable people can have different viewpoints.
Personally, I am quite in favor of the religious center being built there and believe that the Imam behind it is quite sincere in his intentions (which have been demonstrated for years). It would, in fact, be one of the biggest defeats for the radical nutjobs who were behind the terrorist attack in the first place. It demonstrates in spades that we are a stronger people than the coward-idiots who pursue their agenda through killing innocents. I think those who have flogged this into an issue are doing it to create a wedge issue for the upcoming election by bringing out the Islamophobia and knee-jerk xenophobia of their mindless followers.
A well reasoned argument is like a diamond: impervious to corruption and crystal clear - and infinitely rarer.

No, it doesn't rest purely on property rights. It should, but when there are people claiming that it is offensive and asking what can be done to prevent this mosque from being built, then first amendment comes into it. That was not decided by President Obama. It was decided with those that find the mosque offensive. President Obama merely answered those inquiries, using the Constitution to explain why what these protesters wanted was not legally possible. Then you are basically saying that "we" are not a "nation of laws", in which case, there is no real foundation for folks prattling on about a First Amendment right to religious freedom because the result will not be based on law. When the dust has settled, the decision concerning this structure will be determined politically. Yours, Issodhos No, I am not saying that. But some people don't realize, or want to realize that we are a nation of laws and that the laws are to apply to everyone equally. So that is why explanations are needed, and why sometimes we have to go to court for a judgment on where and how the laws are applied.

It amazes me that the same people who so stridently urge the court to vigorously police infringements of the Second Amendment will, before they have run out of breath, howl about enforcement of the First.

 'The Tower' is no longer called the 'Freedom Tower' (thank gawd), the Tower is now simply called One World Trade Center. Framing is set to be completed at the end of 2011, and open for bu$ne$$ in June 2013.
