Rick:

If the judges lifted the stay and the case were reversed by the Supreme Court, there would be even more married couples in a state of limbo.

My prediction is that the SC will allow the case to skip the en banc stage because the conservatives on the high court will be looking for a win before the November election.

Remember, the Ninth Circuit is the most liberal in the country, so there's little likelihood there will be a reversal at that level.
