I've been absent for a bit. My honey and I had the opportunity to enjoy our lakeside timeshare - it just reopened - so we took it. This week would have been my family reunion - that was canceled due to COVID. Then this week. Wow. Four SC decisions this week - LGBTQ+, DACA, no gun cases accepted (leaving all regulations in place), and no sanctuary city review (leaving sanctuary ordinances in place), which makes me worried about the abortion cases still pending. CJ Roberts likes to "balance" the Court's decisions. Then, there are the shootings in Atlanta and New Mexico that got me all stirred up, and commenting, and Amy Klobuchar withdrew from V.P. consideration. My head is spinning. My emotions all over the place. I need y'all to get me centered again.

I always suspected that once the Supreme Court got around to it, Trump's silly legal theories would go down in flames. I believe Roberts sees his legacy and place in the history books as more important than the Party that nominated him. He's no dummy: The future is always going to be more along the lines of Progressives because human perception of time only runs in one direction. So how future legal analysts see the Roberts Court is going to be through a more liberal lens.
Soon the court has to decide on the right of congress to oversee the executive branch versus the Imperial Presidency. Right from the beginning, the founders always described checks and balances. I can't see Roberts destroying that, and those decisions will be much more devastating for Trump. These are just the warm-up.
Trump's latest silly legal theory is that anything Bolton said to him is classified. That's a fundamental misunderstanding of the whole classification system, and I think the lower court is going to scold the Justice Department lawyers for filing the prior constraint suit.
