If they can get enough backbone to refer a 14th Amendment violation to the Justice Department for Trump, they don't even have to convict him of any crime. Just giving "aid or comfort" to insurrectionists is enough to be banned from elective office for life. That probably requires a federal judge to agree that happened, but any number of them would, since Trump's "aid or comfort" was quite public. I think such a ban would very quickly end a lot of this BS, since his supporters are much more Trumpers than Republicans.

It should be rather difficult for the Justice Department to ignore a Constitutional Amendment, but there is also a federal statute with the same wording, that also specifies fines and prison sentences. Actually applying a law to a rich person, is their only obstacle at the moment.

The Department of Justice must release a full copy of a March 2019 memo supporting then-attorney general William Barr's conclusion that Donald Trump should not be prosecuted in the Russia investigation.

The District of Columbia Circuit court affirmed a 2021 decision by U.S. District Court Judge Amy Berman Jackson ordering the release of the Justice Department memo, which concluded the former president should not be prosecuted for obstruction of justice by special counsel Robert Mueller.

As AG, Bill Barr had no shame. He auditioned for the job by writing pro-Trump OP-ED pieces supporting Trump. In doing so, Barr became of caricature of a lawyer who then became a miserable excuse for a public servant - a pathetic porcine puppet for a puerile president.

So I wonder if the timing is calculated to disqualify a bunch of insurrection comforters right before the election. So there is no time to come up with substitute candidates on the printed ballots. All votes for them would not be counted, leaving massive Democratic victories. That would be completely legal, in fact. Garland could give republicans say the time before the election they confirmed Amy Coney Barrett: 13 days.

Where do you come up with these schemes?

The timing is calculated to remind Democrats to get to the polls and maybe offer up some ammo for the Democratic candidates.

What Mueller's Report actually says is that he didn't even look into whether Trump was implicated in any of the things Mueller's investigator uncovered about the Russia probe. What Mueller did detail in the second part of his report, however, is that there were at least ten instances of obstruction of justice by Donald Trump. He then gave that list to Congress and testified to Congress about it.

Then AG Bar knowingly, and willingly, mischaracterized the report in his infamous memo writing:

The evidence developed during the special counsel's investigation is not sufficient to establish that the president committed an obstruction of justice offense. Our determination was made without regard to and is not based on the constitutional considerations that surround the indictment and criminal prosecution of a sitting president.

Barr then repeated the lie to Congress.

Not prosecuting a sitting president is pure crap.

That's what the vice-president is for - and speaker of the House, if it goes that far. Trump should have been prosecuted back when he was committing crimes as POTUS. Our country would not be in a J6 mess or stealing classified nuke docs mess we're in today if the right thing had been done back then and indicted Trump for his crimes while presidenting.
