Article 2 - The Executive Branch Section 2 - Civilian Power Over Military, Cabinet, Pardon Power, Appointments
The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any subject relating to the Duties of their respective Offices, and he shall have Power to Grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment. Bush Withdraws PardonWASHINGTON — President George W. Bush took the very rare step Wednesday of revoking a pardon he had granted only a day before, after learning in news reports of political contributions to Republicans by the man's father and other information. Bush pardoned 19 people on Tuesday, including Isaac Robert Toussie of Brooklyn, N.Y., who had been convicted of making false statements to the U.S. Department of Housing and Urban Development and of mail fraud. On Wednesday, the White House issued an extraordinary statement saying the president was reversing his decision in Toussie's case. White House press secretary Dana Perino said the new decision was "based on information that has subsequently come to light," including on the extent and nature of Toussie's prior criminal offenses. She also said that neither the White House counsel's office nor the president had been aware of a political contribution by Toussie's father that "might create an appearance of impropriety." "Given that, this was the prudent thing to do," she said. Question for the lawyers on RR...does Bush have the authority to reverse a pardon? If so, under which law? Just curious. Does it amount to a single handed reconviction?

Having nothing to base my opinion on, other than the Constitution (what a concept) I see no authority to revoke a pardon. But my guess would be that there was some procedure necessary to complete the grant and that it had not yet been completed.

The announcement, as I understand it, was that a pardon was to be issued, but the reality was that it had not been formally signed and put in an envelope. Apparently, the President has decided to delay carrying out the issuance of the previously announced but not yet executed pardon.
But even barring that, if the Pres has the authority to issue a pardon then seems to me he has the authority to tear it up and throw it away before delivering it.

Not too surprisingly the Pardon was withdrawn not because the guy was a total slimeball who ripped off minorities and poor people, but because his father donated $28K to Republicans and the President didn't want it to be see as an impropriety to issue the pardon. For whatever reason and whether it is technically within the letter of the law I am pleased to see the pardon withdrawn.

Before President Bush pardons anyone, he should pardon U.S. Border Patrol officers Ignacio Ramos and Jose Alonso Compean before he leaves office. If President Bush can pardon and commute sentences to felons like Scooter Libby, he certainly should pardon both Ramos and Compean. No matter what your opinion may be on the fraudulent so-called "war on drugs" this is the opportunity for the President to right a grievous wrong. Emma Facts don't matter to some people. To some people all they look at is 2 US border officers vs 1 illegal immigrant that was a drug dealer. The illegal immigrant is to be treated as a non-human in their minds and deserves no rights what-so-ever. Now, I'm against illegal immigration as much as the most conservative Republican out there. But what those border patrol agents did is not right no matter how you look at it.
