I agree with you 100% only if these "religious businesses" would pay their damn taxes. Until then they should not discriminate at all. How are you defining "religious businesses", kap17? Churches are already required to pay taxes on unrelated business income. Yours in curiousity, Issodhos

What we really have here is a direct conflict between fundamental rights guaranteed by the Constitution - on the one hand the 1st Amendment's guarantee against state interference with religion (and tangentially, freedom of association) against the individual right to freedom from discrimination based upon an inappropriate criteria (sexual orientation). We are half in agreement, NW Ponderer, especially with regard to the right to freely associate, but I see no right to be free from discrimination other than in relationship of the individual to the state (e.g., equality under the law). Protection from non-government discrimination based upon selected criteria can only be legislated, and thus would seem to be not a right so much as a government granting of privilege as well as a government infringement on the right of one individual to the benefit of another individual.
